1. Acceptance of Terms

By accessing or using the Mr.GC platform, including our website and mobile application, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services. We reserve the right to update these terms at any time, and your continued use of the platform constitutes acceptance of any modifications.

2. Description of Service

Mr.GC is an AI-powered marketplace that connects New York City homeowners and businesses with licensed contractors for construction, repair, and maintenance services. We provide AI photo analysis, contractor matching, secure payment processing through Stripe, OTP-based arrival verification, and a live work timer. Mr.GC acts as an intermediary platform and is not itself a contractor or construction service provider.

3. User Accounts

You must create an account to use Mr.GC. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration. Customers and contractors have separate account types with different roles, permissions, and obligations. You may not transfer your account to another person without our prior written consent.

4. Payment Terms

All payments are processed through Stripe. When a customer selects a contractor, a payment hold equal to 1 hour at the contractor's hourly rate is placed on the customer's card. The customer is prepaid for 2 hours of work. After job completion and dual-party confirmation, the actual amount based on hours worked (rounded up to the nearest whole hour, minimum 1 hour) is captured. A platform fee of 12% (or lower based on contractor tier) is deducted from the contractor payout. Rush Service incurs a flat $300 platform fee. Refunds are issued in accordance with our dispute resolution process.

5. Contractor Obligations

Contractors must hold valid, active NYC trade licenses as applicable to their listed trades. Contractors agree to arrive at the job site within the agreed timeframe, verify their arrival via the OTP system, perform work in a professional and workmanlike manner, and accurately log their working hours through the platform's timer. Contractors may not solicit customers for off-platform transactions. Violations may result in account suspension or permanent removal from the platform.

6. Customer Obligations

Customers agree to provide accurate photos and descriptions of their repair needs, maintain a valid payment method on file, provide the OTP code to the contractor upon arrival, and confirm job completion in a timely manner. Customers may not solicit contractors for off-platform work. Customers must ensure the job site is accessible and safe for the contractor to perform work.

7. Dispute Resolution

In the event of a dispute between a customer and contractor, either party may initiate the dispute resolution process before confirming job completion. Funds will remain in escrow until the dispute is resolved. Mr.GC uses AI-assisted severity classification followed by human review when necessary. Both parties will have the opportunity to present their case. Mr.GC's determination on disputes is final and binding within the platform.

8. Limitation of Liability

Mr.GC is a marketplace platform and does not perform construction work. We are not liable for the quality, safety, or legality of work performed by contractors. To the maximum extent permitted by law, Mr.GC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability for any claim arising from these terms shall not exceed the amount of platform fees you have paid to Mr.GC in the 12 months preceding the claim.

9. Modifications

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes via email or through a notice on the platform at least 14 days before the changes take effect. Your continued use of the platform after such modifications constitutes your acceptance of the updated terms. If you do not agree with the modified terms, you should discontinue use of the platform and close your account.
